The 34-year-old plaintiff was in a car accident while stopped in traffic when a truck allegedly backed into her car.

Following the accident, the she saw a chiropractor for her neck pain. The chiropractor had an MRI done which revealed a central disc herniation at C5-C6 with mild cord compression.

She underwent surgery and returned to work after six weeks and had only slight residual pain.

Her case was complicated by a pre-existing neck condition two years earlier.

The plaintiff's medical bills for the first surgery were $27,837 and she missed approximately six weeks of work, but because she was paid on a commission basis, she could not show any diminution in her earnings.
